I Can
Yo puedo

I canYo puedo

I can explain what a producer must clear before using a sample by judging two real cases with the four-factor test.

I know I have got it whenSé que lo logré cuando

  • I can name the two rights inside one recording, and say which one a sample needs.
  • I judge each case with all four questions, not only the one I agree with.
  • I justify what I would have done, and name the factor that decides it.Justifico qué habría hecho yo, y nombro el factor que lo decide.

Una grabación, dos derechos
A song, and a recording of that song, are two different works.
  • Take a sample off a record and there can be two people to ask.
  • Asking them, before the track goes out, is what clearance means.

U.S. Copyright Office, Circular 56: a song and a recording of that song are two distinct works.

I Do
The Four Questions
Las cuatro preguntas
